Asumuseroon tuomittaessa puoliso velvoitettiin AL 46 §:n 1,2 ja 4 mom:n, 51 §:n 1 ja 2 mom:n sekä 80 §:n 3 mom:n ynnä ElatusL:n nojalla suorittamaan asumuseron aikana elatusapua toisen puolison ennen avioliittoa syntyneelle, yhteisesti elätettäväksi otetulle alaikäiselle lapselle.
